By accessing or using Crop Yield ("Service"), operated by AGC Consulting, LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Crop Yield is a grain-marketing decision-support platform. The current customer features are:
Corn and soybean reference prices from public futures data.
USDA MMN Iowa regional cash context.
Per-crop break-even tracking.
Iowa licensed elevator directory.
Saved basis and estimated cash context.
Grain sale logging with weighted averages.
In-app price alerts.
The Service is intended for decision-support purposes only and does not constitute financial, investment, or agricultural advice.
3. User Accounts
You must provide a valid email address to create an account.
You are responsible for maintaining the security of your account credentials.
You must be at least 18 years old to use the Service.
One account per person. Accounts are non-transferable.
4. Subscription Plans and Payments
Limited access: Accounts without an active paid subscription have limited access to features.
Starter ($9/month): Access to the current launch feature set described above.
Pro ($19/month): Everything in Starter, plus SMS delivery of your price alerts (requires a separate SMS opt-in, see section 8), export of your grain sales history, and priority email support.
Lifetime Founding Member ($199.99 one-time): A single payment granting everything in Pro for the life of the account, with no recurring fee, plus priority email support. Non-refundable after 30 days.
Payments are processed securely through Stripe. We do not store your full card number.
Subscriptions renew automatically. You may cancel at any time through your Settings page or the Stripe Customer Portal.
Beta access codes, when offered, grant temporary Pro-level access for a limited period.
Beta access expires automatically and does not auto-renew.
Beta features may change or be removed without notice.
6. Acceptable Use
You agree NOT to:
Use the Service for any unlawful purpose.
Attempt to gain unauthorized access to any part of the Service.
Reverse engineer, decompile, or disassemble the Service.
Use automated systems (bots, scrapers) to access the Service.
Resell, redistribute, or sublicense access to the Service.
Interfere with or disrupt the Service's infrastructure.
7. Data Accuracy Disclaimer
Reference prices for corn and soybeans are derived from public futures data and are provided "as-is".
USDA MMN Iowa regional cash context is regional decision-support information. It is not a named elevator bid, and it may lag or contain errors.
Saved-basis estimates and estimated cash context are calculated from your inputs and public data. They are estimates only.
All data may be delayed, incomplete, or contain errors. You must confirm any actual cash bid directly with the elevator before selling.
Nothing in the Service constitutes financial or agricultural advice. Consult a qualified advisor before making selling decisions.
Past performance and historical data do not guarantee future results.
8. SMS Communications
Crop Yield operates an optional SMS price alerts program delivered via Twilio from +1 (712) 545-5420.
SMS is available only to users who separately and explicitly opt in. SMS consent is optional and is not a condition of purchase, account creation, or use.
Adding a phone number to your account alone does not opt you into SMS. SMS consent is collected separately.
Message frequency varies by your alert settings. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help.
The Service retains server-side consent checks, idempotency, quotas, and delivery controls to prevent duplicate or unwanted messages.
9. Intellectual Property
All content, features, and functionality of the Service are owned by AGC Consulting, LLC and are protected by copyright, trademark, and other intellectual property laws.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGC CONSULTING, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF CROPS, OR LOSSES FROM SELLING DECISIONS MADE BASED ON INFORMATION PROVIDED BY THE SERVICE.
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless AGC Consulting, LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
12. Termination
We may suspend or terminate your account for violation of these Terms.
Upon termination, your right to use the Service ceases immediately.
13. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the State of Iowa, United States.
